At this point in time, it’s not clear whether Elena Kagan will be confirmed to the Supreme Court. I am excited by the idea of three women on the Court. We are a majority of the population, but to get 1/3 representation would be historic.
Having read the Nets, and listening to NPR as I drive around in my work, I have an optimism about Elena Kagan, and think she will be a good and fair judge. If I turned my radio dial to other channels, I’d be sure she’s the Harriet Miers of the Obama administration.
It tickles me when the R-Wing has to reference the former administration to find examples of iconic incompetence. I always felt that Harriet Miers got screwed. If you had a chance to reach the absolute peak of career glory, would you be objective enough to recognize that you should ‘Just Say No’? I thought so.
So think about Harriet Miers, first set up, then knocked down. It’s a disgraceful way to treat someone who has worked for you with dedication and trusted you as a boss. Shame on you George W. Bush for turning a loyal staffer into a byword. Shame, shame–go cut some brush.
In future years, when we have digested and derived nourishment from our banquet of instant communication, and when our attention span exceeds the impulse of the channel changer or the mouse– we may learn to chill and look a couple of steps ahead.
My Kmareka prediction, since our specialty is reporting the news before it happens, is that our President will make one more Supreme Court appointment before the end of his term. I think that Elena Kagan is something of an unknown quantity, but it matters a lot to me to have three women on the Court, and I don’t see anything in her record to outweigh that. It is now a 5/4 split, but by 2012 it will be 4/5.
If I’m wrong, this post will disappear into the swamp of failed predictions. If I’m right– you heard it here first.
UPDATE: A blogger who uses more than tea leaves to make his predictions has a post saying essentially the same thing as your humble correspondent. They’re starting to catch on, but Kmareka is the leading edge.
